I would think it would be a very difficult case for them to win. the ICC can't do anything really, the legality of the war itself is beyond their purview. though they're going to fully analyse the report to see if there are any incidents in there that warrant investigation of specific soldiers or others over there (torture, violation of rules of engagement, etc.).
