I'm not disagreeing with the difference response (the after the fact response or some Capitol police helping with barricades and taking selfies etc.), I'm talking about going through due process beforehand to prevent this.

One thing is for sure though, the US legislative response to this will be guaranteed to give more power to law enforcement.

I think you're giving way too much credit to the capacity and capability of local law enforcement agencies. But yes there's also the likelihood that local law enforcement agencies (especially in rural areas) have strong ties with these individuals....

They should put some of these terrorists into Guantanamo to torture them and see if they have more information. They got way closer to do serious damage than most Al Qaida or other Islamist terrorists. Since the US is all about antiterrorism and inner security that would be the logical path.

Now of course they should have been more prepared, but even when the Maryland Governonr called for back-up, he was denied by Acting Chief of DoD Christopher Miller (installed by Trump weeks before the assault on the Capitol):

The storming of Capitol Hill was organized on social media.

At least a dozen people posted about carrying guns into the halls of Congress.

I mean, US Intelligence even spies on European allies. How can they not follow right wing social media the days before this happened?

These fascists are skiing down slippery slopes. Too much benefit of the doubt all around.

The shirts could have been investigated. That message seems to suggest sedition to me, maybe criminal conspiracy. 

You can only say "that'll never hold up" in court so many times before people lose faith in the court. Then what? Are we missing a classification of crimes here? Are we just going to wait out the clock on domestic terrorism until they do some real damage? Until vigilantes take justice into their own hands?

What if they were investigated and the FBI (or whoever) didn't find evidence to meet the burden of proof required by the courts (you know, the same courts that rightly required evidence by Trump's legal team on their claims of election fraud)?

Flip the script: what if these guys were wearing "FUCK CAPITALISM - VIVA LA REVOLUCION" shirts with a date on them. Would you want them investigated?

Honestly, no, because their chances of success are effectively zero - see Occupy, etc.

One side of this divide is so much more skilled at weaseling their way out of anything.
